Terms of sale

These Terms and Conditions of Sale are entered into between:

FALLON, a simplified joint-stock company (Société par Actions Simplifiée - SAS) with a share capital of €10,000, registered with the Paris Trade and Companies Register under number 950 724 575, with its registered office located at 108 avenue Ledru-Rollin, 75011 Paris, France, represented by its President, Fallon Castella, hereinafter referred to as the “Seller”, and any person making a purchase via the website fallon.store, hereinafter referred to as the “Buyer”.

These Terms and Conditions of Sale define the rights and obligations of the Parties in connection with the online sale of products and services offered by the Seller to the Buyer.

The Terms and Conditions of Sale are accepted upon validation of the order. By proceeding with payment, the Buyer expressly acknowledges full and unconditional acceptance of these Terms and Conditions.

As the Terms and Conditions of Sale may be amended, the conditions applicable to any order are those in force on the date the order is placed.

Article 1 - Prices

Prices for products are indicated in euros (€), inclusive of all taxes, excluding shipping and handling fees.

All orders must be paid in euros.

For products shipped outside the European Union and French overseas territories, prices will be invoiced excluding taxes. Any customs duties, local taxes, import duties, or state taxes are not the responsibility of fallon.store and, where applicable, shall be borne entirely by the Buyer, who is solely responsible for their declaration and payment to the relevant authorities.

The Seller invites the Buyer to obtain information regarding these matters from the appropriate local authorities.

If the Buyer refuses to pay applicable duties or taxes, the order will be cancelled. Shipping and customs clearance costs incurred as a result of such cancellation will be deducted from the refund issued to the Buyer.

FALLON reserves the right to modify prices at any time and without prior notice. Such changes shall not affect orders that have already been accepted by FALLON.

Tax and Customs Policy : please note that the recipient is responsible for all applicable customs and import duties.

Article 2 - Payment

Payment is due immediately upon placing the order. Payments are made on the website by credit card and are secured and encrypted via Stripe.

The following payment methods are accepted:

- Credit cards (Visa, Mastercard, American Express, JCB)

- PayPal

Article 3 - Product availability

Products displayed on the website are those available in stock at the time of the Buyer’s visit.

In the event that a product becomes unavailable after an order has been placed, FALLON undertakes to inform the Buyer as soon as possible by email or telephone. The unavailability of a product may result in cancellation of the order and a refund of the corresponding amount.

Article 4 - Product condition and quality

The website fallon.store offers for sale vintage, second-hand, and new products from contemporary brands selected by FALLON.

Vintage or second-hand items may show natural signs of wear and age. The quality of the goods delivered corresponds to that described at the time of purchase. Each vintage piece is carefully evaluated, professionally cleaned, and restored when necessary by skilled artisans.

FALLON makes every effort to disclose any minor defects associated with vintage or second-hand items within the product description.

A vintage grading scale may be provided to indicate the condition of applicable pieces:

  • Excellent: no signs of wear, new or never worn
  • Very Good: minor signs of wear
  • Good: may show visible signs of wear such as stains, pulled threads, or slight discoloration
  • Fair: obvious signs of wear or piece primarily intended for collection or inspiration purposes

New products from contemporary brands are sold in new condition and in accordance with the descriptions displayed on the website.

Article 5 - Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to vintage or second-hand items sold on the website fallon.store, as these constitute unique goods, individually selected and liable to deteriorate or lose value as a result of handling or use.

Any order consisting exclusively of vintage or second-hand items is therefore final and binding.

For new products from contemporary brands, the Buyer has a legal period of fourteen (14) days from receipt of the order to exercise their right of withdrawal, without having to provide justification.

Returned products must be:

  • unused
  • in their original condition
  • returned with their original packaging and accessories, where applicable

Return shipping costs remain the responsibility of the Buyer.

Any incomplete, used, damaged, or unsellable returned product may be refused.

Article 6 - Customer accounts

Creating a customer account is not required in order to make a purchase on the website.

Article 7 - Affiliate disclosure

Certain links on the website may be affiliate links. This means that FALLON may receive a commission if the Buyer clicks on such a link and makes a purchase. FALLON aims to recommend products or services believed to be of high quality and relevance, regardless of whether compensation is received.

However, FALLON is not responsible for the actions of its affiliate partners, and any transaction carried out via an affiliate link is subject to the partner’s own return, refund, and customer service policies.
